The Books & Pornographic Material Found In Neverland

Time and again we see the claim that child pornography was discovered in Michael Jackson’s bedroom. It’s either coming from a detractor, tabloid, comment section, or even, the mainstream media. Who those claims are not coming from, though, is the police and prosecutors involved with the cases:

During both the 1993 and 2003 raids on Neverland – which in 1993, also included a search of Michael’s condo, his Las Vegas hotel suite, his offices, his family’s home Hayvenhurst, and the offices of his dermatologist and plastic surgeon- no physical evidence of child pornography was found. There was no evidence in digital format, either. The police confiscated and reviewed computers ( hard drives, browser and download history/ all computer contents), audio tapes, video tapes, private journals and notebooks.
Prosecutor Ron Zonen confirmed the absence of any such material in a statement in 2016 when Radar Online tried to claim that child pornography had been found:
“There were all kinds of conventional porn magazines.” “Things like Playboy, Penthouse. There was one called Barely Legal. It was a publication that featured young women presumably over the age of 18 but selected because they look much younger.”
“There were photos of nude children but they weren’t sexually graphic." “They weren’t children engaged in sexual activity and there was no child pornography. There were no videos involving children. There were videos that were seized but they were conventional adult sexually graphic material. No children involved.”
Specifically, the nude images of children he says, showed children “playing in the stream, climbing trees, nature photographs, nudist colonies, things like that." “They came from professional publications. Were they designed for pedophiles or designed as artistic photographic books I can’t comment on that.” [2]
Possessing child pornography is a crime in itself. Michael would have been charged and most likely jailed for this alone, even if he was acquitted on all the others. He was never charged with possession of child pornography.
Police extensively searched Michael’s premises both in 1993 and in 2003 and sexually explicit material featuring children was never found. What is being used against Michael and falsely labelled as “child porn” or “child erotica” is nothing more than a series of legal art photography books that were in his home.
The books found in 1993
Boys Will Be Boys -Georges St Martin & Ronald C. Martin 1966

This book displays photographs of boys in various states of dress: fully clothed, semi nude, and fully nude while they engage in activities like skinny dipping, climbing trees, playing, etc. None of the photos are sexual or pornographic. The book cover offers a bit of context as you can see it would be appropriate for the boys to appear semi nude for swimming. You'll find more photographs like this inside the book.

The Boy: A Photographic Essay - Georges St. Martin & Ronald C. Nelson 1964
This book contains pictures of boys in various situations by different photographers, including pictures taken during the filming of the 1963 Lord of the Flies movie. They do include nude photographs, but the photographs are not pornographic or sexual. They show the boys in various non-sexual activities. There is a mix of dressed, semi dressed, and nude boys at play.
Interestingly, this book is thought to be a gift from a fan. There is an inscription inside the cover that reads: “To Michael: From your fan, “Rhonda” ♥ 1983, Chicago”

In Search of Young Beauty - Bois Hodges 1964

This book features photographs of boys and girls mostly dressed, but some semi nude or nude. None of the photographs are pornographic or sexual.

All three of these books are in the United States Library of Congress.
These books were not found in the context of an excessive collection of nude photographs of children, but they were found in the book collection of someone who was generally interested in photography, art photography, art history, book rarities and vintage books and not specifically focused on nude photographs of children.
Now, unbeknownst to the general public, The Boy: A Photographic Essay and Boys Will Be Boys! were reportedly published by authors involved with the NAMBLA (North American Man/Boy Love Association) organization. The books were written under pseudonym’s aka fake names, which you can see below.

This is the controversial tie that keeps detractors holding on to the false claim that these books are meant to be erotic or pornographic in nature. As unsettling as their crimes were, it doesn't change what is actually depicted in the books nor does it mean anyone in possession of these books shares a link of any kind to NAMBLA. In fact, you will find these books in most college libraries and online book stores as they're still highly regarded.
Jonathan Spence

Aside from the books listed above the prosecution’s January 18, 2005 motion also mentions two photographs allegedly found in the 1993 search. One is described as “a photograph of a boy, believed to be Jonathan Spence; fully nude [6]” and the other is described as “a photograph of a young boy holding an umbrella; wearing bikini bottoms, partially pulled down [6]”.

These photographs are often mentioned as the bombshell evidence of Michael's guilt, but in reality we have never seen these photos. Both in 1993 and 2005, the prosecution never proved the existence of these alleged photos. This would be a strong piece of evidence to bring to Court. But they didn't, so the defense never got a chance to see or cross-examine them.
During a trial, either side can make claims in their motions but whatever claim they make they need to prove in court to be accepted as facts. Prosecution motions are sometimes just that: baseless claims, theories, and opinions by one of the parties. In actuality, in this case prosecution motions often included claims which were twisted or even turned out to be totally untrue in court – some even refuted by the prosecution’s own witnesses.
Prosecution in Michael's 2005 trial claimed to have these photos in a motion, but when they finally got to introduce their 1993 findings to the court, after the Judge ruled on the admissibility of “prior bad acts” evidence in March 2005, they only introduced the art books found in the 1993 search . They made a motion, and then they never mentioned these alleged photos again either in court or in other motions requesting the introduction of items found in 1993. There is no evidence of their existence.
One might assume they kept the photo evidence out of court to protect the child depicted in the photo, but consider the nature of the allegations of the trial. Those photos would have been the strongest physical evidence of the entire case, as by the prosecution's own admission, “the search warrant didn’t result in anything that would support a criminal filing.” [2].
Ultimately, the judge turned down the prosecution's attempt to introduce testimony about Jonathan Spence on March 28, 2005. Not because the court was acting in favor of Michael Jackson, but because all the prosecution could offer regarding Jonathan were testimonies about the supposed “grooming” based on the fact Michael bought him gifts. Buying gifts was very common with Michael. He bought gifts for many of his family and friends, kids and adults alike. Giving gifts isn't uncommon, especially for someone who could afford to do so, and who was a well known humanitarian. [5]
The testimonies, if you were wondering, would be given by such people as Bianca Francia and LeRoy Thomas. You may recognize them as two of the many disgruntled ex employees who began selling fake stories to Hard Copy for money. They'd later admit under oath to lying on Michael about witnessing inappropriate behavior between him and any of the boys. That was all the evidence they could offer to the court about Jonathan and that is why the Judge wouldn't allow him to be introduced to the court as one of Michael’s alleged victims.
It's been almost 32 years since the 1993 case, and almost 20 since the 2005 case and these two photos have never been released or "leaked" like so much of the other court documents and evidence. Thomas Mesereau, Michael's lawyer in the 2005 trial, was asked about these alleged photos in a podcast by King Jordan Radio and he said he's never seen those photos, so it was never even shown to the defense. Prosecution is obligated to share any and all evidence that they want to introduce to the court with the defense.
Under Penal Code 1054.1, the prosecution must disclose all relevant evidence to the defense. If the prosecution withholds evidence, the defense can file a motion to compel discovery. [7]
The claim is these photos were allegedly found in 1993, but Jonathan Spence who met Michael when was 5, and spent time with him between the ages of 10-16, said he was not abused by Michael. To this day he has never claimed anything inappropriate happened. Jonathan even got married at Neverland in 1997, despite rumors that he was "replaced" by James Safechuck and Omer Bhatti, and no longer a friend of Michael's.
"When we hang out. He’s just like any other guy. He never talks about himself, only about what is going on with others. We never talk about show business. Sometimes he’ll put on a disguise when we’re in public. When we go to Disneyland, we’ll go through the back and take all the alleys and back ways and get in front of the lines. He can’t wait in the line, no way. He would cause a riot. We move fast through Disneyland; if people get a good look at him, that’ll be it for that outing.
‘He’s one of the nicest people I’ve ever known. He’s smart. He knows a lot about everything. He’s a kid. He never really had a childhood, and he’s having it now. The stuff I read in the papers about him, I know it’s all a bunch of B.S. I just ignore it. A couple of times I’ve asked him about girlfriends and stuff, but we never really get into that. We don’t talk about the plastic surgery either, because it’s none of my business. He never brings it up. It’s not like he says, “Well, how do you like my new chin?” -Jonathan Spence in the J. The only material evidence they produced were art photography books, vintage nudist magazines, and heterosexual pornographic magazines and DVDs. The prosecution spent days presenting the heterosexual adult magazines to the court which the jury felt was irrelevant to the case. The evidence of these photos has never been produced so we cannot assume their discovery nor their existence to be factual.

Rod Mcrae - Camp Cove, Photos of Sydney Men (2001)

A book with artistic, non-sexual photos of adult men, including nude and semi nude photographs in various settings both indoors and outdoors. The author is a renowned artist and sculptor.
DRESSUP - Starr Ockenga 1978

A collection of black and white photographs of children dressing up in various roles and settings. The author is a renowned photographer.


Dave Nestler: Wicked Intentions, 2002
Nude and semi nude erotic animations of adult women.


Kelly Klein- Underworld, 1995

Kelly Klein (ex-wife of Calvin Klein) works as a photographer. The book is about underwear, and contains artistic photographs of people in underwear. The band Red Hot Chilli Peppers is featured.



Jake Chapman, Dinos Chapman, Gillian - Fourth Sex: Adolescent Extremes, 2003

Artistic photographs of youth counter culture.
A counterculture is a culture whose values and norms of behavior differ substantially from those of mainstream society.

Pere Fomrgeura - Cronos, 2000

“This book documents Pere Fomrguera’s Chronos project, in which he took subjects whose ages ranged from two to seventy-five at the project’s beginning, and photographed them once a month over a ten-year period.”
John Patrick Salisbury - Drew and Jimmy 1995

Artistic photographs of two teenage boys in rural Louisiana. According to the prosecution they confiscated it because in some of the photos the boys were wearing swim-trunk type of clothing. The author is a renowned photographer who worked with celebrities on their album cover art, among others Alanis Morisette.
Rineke Dijkstra - Beach Portraits, 2003


Artistic photographs of children and young people in a beach setting in swimwear. The author Rineke Dijkstra is a Dutch photographer and she is considered one of the best portrait photographers of today.
James Bidgood & Bruce Benderson - Bidgood, 1999

A book about the life and work of American artist – photographer, filmmaker – James Bidgood. The book includes nude or semi nude artistic photos of men in various, non-sexual, fairy tale-like settings. The book was published by the publisher Benedikt Taschen who specializes in art, photography and art history books.
Michael’s attorney, Thomas Meserau mentioned at the 2005 trial that Taschen has sought to work with the Jackson family and that he sent this book to Michael [20]. There were also other Taschen publications among the confiscated books.

Naked As A Jay Bird - Dian Hanson, 2003

Another book published by Taschen that the prosecution confiscated. This one was described by them as “nude adult male and female erotica; very graphic”. The book is about the history of the American nudist magazine “Jaybird” that was published in the 1960s.

The Glory of de Dienes Women -Andre de Dienes, 1967

Photos of nude women by Andre de Dienes who, among others famously photographed Marilyn Monroe.

The Chop Suey Club - Bruce Weber, 1999

Artistic photos of a young man by Bruce Webber. In most of the photos the subject is clothed. Out of around 150 photos in the book there are about 5-6 nude photos. The book also includes photos of the subject with various celebrities – for example, Pamela Anderson, and it has brief texts by artists and celebrities such as Bruce Springsteen.
Webber is very much renowned for his uniquely stylish and elegant photography and worked on many ad campaigns for Calvin Klein, Ralph Lauren, Pirelli, Abercrombie & Fitch, Revlon, and Gianni Versace, as well as with magazines such as Vogue, GQ, Vanity Fair, Elle, Life, Interview and Rolling Stone.
He has famously photographed many celebrities, among them Madonna, Halle Berry, Leonardo di Caprio, Channing Tatum, Natalie Portman, Brad Pitt, Bruce Springsteen, David Bowie and Michael Jackson. He first worked with Michael in the ’70s when he was still a member of the Jackson 5, then again in 2007. Michael’s defense at his 2005 trial said that Weber sent this book to Michael unsolicited [21].


Maxwell Photographs, 2000

A collection of artistic photography by Robert Maxwell. The book includes some nude and semi nude photos. It was indicated by Michael’s defense at his trial in 2005 that Maxwell is a personal friend of the Jackson family. He is another photographer who has worked with a number of celebrities including Angelina Jolie, Yoko Ono, Natalie Portman, Johnny Depp.
The book is in the United States’ Library of Congress [24].


Tom Bianchi - Bob & Rod, 1994

A compilation of non-sexual, artistic photographs of two males who are mostly nude or semi nude. The subjects are Bob Paris and Rod Jackson who were one of the first famous gay married couple in the United States, appearing on many talk shows – including Oprah Winfrey – in the late ’80s-early ’90s.

Non-sexual, artistic photos of nude men. The book is a rare, vintage book published in the 1970s.

Larry Stevens – A Sexual Study of Man (1970)
Unfortunately, I couldn’t find any photos of this book but it’s described as follows:
A compilation of photographs, drawings, cartoons and writings about homosexual activity between adult men.
This book was introduced in court by the prosecution and was even brought up in their closing statement as they believed it proved Michael was homosexual. Out of his entire collection of books, it was the only one in Michael’s possession that depicted male on male sexual activity. They suggested this rare and vintage1970s book that Michael had in a cardboard box in the midst of hundreds of other art and photography books “proved” that he was homosexual, despite the more accessible heterosexual pornographic magazines and DVDs that Michael regularly bought and kept close by in his nightstand or by his bed.
Most of these books were found in big cardboard boxes throughout Michael’s master bedroom and bathroom among many other art, photography, and history books. Many were vintage books or rarities possibly from second hand stores and meant to be collector’s items. As you can see from above, some of pictures in the books are graphic or sexual in nature, but none of them contain children. All the books are legal and most can be found in the library of congress, bookstores, college libraries, and in the collections of art and photography lovers worldwide.

The nudist magazines
The prosecution also confiscated and introduced a number of nudist magazines to the court. Magazines that they found during the 2003 search. These were old, vintage magazines from the 1930s and some from the 1960s, which are considered collector’s items and can be as much as several hundred of dollars per magazine on some auction sites. In the January 18, 2005 prosecution motion District Attorney Thomas Sneddon claimed that the nudist magazines were found in a box at the foot Michael’s bed [11] and then again, he repeated this misinformation in his opening statement at the 2005 trial [15]. However, his own police officer, who confiscated this material, debunked him in her trial testimony. Janet Williams testified that she had found these magazines inside one the big cardboard boxes that contained many books in the downstairs area of Michael's bedroom and it is not known if he ever opened them [9]. (Michael’s bed is upstairs while the downstairs is used as a sitting area. As Janet Williams described in her own words: “The area appeared to be similar to a sitting room. It had a piano, large screen televisions and chairs, and some books. Fireplace. That kind of area [6].”

As I wrote earlier, there was legitimate pornography found in Michael's home during the 2003 raid. The prosecution never claimed it was illegal, in fact, they admitted that all of this was legal, commercially produced material and none depicted illegal activities such as child porn. They claimed that Michael used the pornography to “groom” children for sexual abuse. Keep in mind, they confiscated the art books to prove Michael's own attraction and interest in children and believed the heterosexual pornography was specifically for "grooming" purposes.
In 2003, accuser Gavin Arvizo and his brother Star Arvizo alleged that Michael showed them adult magazines. However, under cross examination Gavin falsely testified to being shown a specific magazine that wasn't even produced until months after his last visit to Neverland.
Most of these adult magazines were found in Michael’s nightstand, in a box at the base of his bed and in a briefcase in his bedroom closet. Some others were found in a cabinet in his office bathroom and in the bathroom inside his master bedroom. Michael's fingerprints were found on them, and his attorney Thomas Mesereau admitted to this in his opening statement:
“The prosecutor told you that there were girlie-type magazines and sexually explicit material in Mr. Jackson’s home, and there were. Mr. Jackson will freely admit that he does read girlie magazines from time to time. And what he does is he sends someone to the local market, and they pick up Playboy and they pick up Hustler, and he has read them from time to time. He absolutely denies showing them to children.” [5]
The prosecution spent days displaying the pornographic magazines that they had confiscated from Michael's bedroom in court to a confused and bored jury [6]. All that was to be gained from the presentation is the confirmation that Michael was very much interested in adult women. If he wanted to use porn to "groom" children, one or two magazines would have been enough. He wouldn't need an entire collection. The prosecution's presentation felt like an attempt to embarrass Michael, as they failed to prove this material was explicitly used to "groom" his accuser.
Below I've included lists of the nudist magazines, pornographic magazines, and DVDs that were seized from Neverland. But first, what was found on Michael's computers?
The Internet pornography
In the 2003 raid, police confiscated sixteen computers from Neverland, including three computers (which contained four hard drives in total) from Michael’s bedroom, and sent them to the FBI for a forensic examination of their hard drives. None of the computers contained any illegal material or had any traces of access to illegal material on the Internet, including no attempts to find such material [7]. Once again, according to court transcripts and court motions, only legal adult heterosexual pornography and images of nude women were found cached in his hard drives from 1998 through 2003 and as Michael’s lawyer pointed out in his closing statement at the 2005 trial: “No illegal child pornography, either in a website or anywhere else. No websites where you try to meet children, like pedophiles often do, and the rest [8].”
